Ohio — John W. Judge Co. v. USA Freight, LLC, No. 7708, decided 7/6/18.The Ohio Court of Appeals, in upholding a default judgment, held that where an LLC chose as the address of its statutory agent an office where it was possible for a non-English speaking person, unaffiliated with the LLC, to receive and mishandle important documents, the LLC’s failure to receive notice did not constitute excusable neglect. The LLC is responsible for maintaining a valid statutory agent that is calculated to receive service of process at its listed address.
