Delaware — Tiger v. Boast Apparel, Inc., No. 23, 2019, decided August 7, 2019. The Delaware Supreme Court held that there is no presumption of confidentiality in Sec. 220 productions. The Court of Chancery must assess and compare benefits and harms when determining the initial degree and duration of confidentiality. Furthermore, an indefinite period of confidentiality should be the exception and not the rule.
